3. Intellectual Property

a. Ownership:

The Site and Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Patriot Realty Group, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

b. Limited License:

Patriot Realty Group grants you a non-exclusive, non-transferable, revocable license to access and use the Site and Services for your personal, non-commercial use only. This license does not include any resale or commercial use of the Site or Services or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Site or Services or their contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

c. No Unauthorized Use:

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site or Services, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.You may store files that are automatically cached by your Web browser for display enhancement purposes.You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

4. Disclaimer of Warranties

a. As Is:

The Site and Services are provided "as is" and without warranties of any kind, either express or implied.

b. No Warranties:

To the fullest extent permissible pursuant to applicable law, Patriot Realty Group disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

c. No Guarantee:

Patriot Realty Group does not warrant that the Site or Services will be uninterrupted or error-free, that defects will be corrected, or that the Site or Services are free of viruses or other harmful components.

d. Accuracy:

Patriot Realty Group does not warrant the accuracy, completeness, or timeliness of the information provided on the Site or Services.

5. Limitation of Liability

a. Indirect Damages:

In no event will Patriot Realty Group be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Site or Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Patriot Realty Group has been advised of the possibility of such damages.

b. Direct Damages:

Patriot Realty Group's total liability to you for any damages (direct or otherwise) arising out of or relating to your use of or inability to use the Site or Services shall be limited to the amount you paid to Patriot Realty Group for the Services, if any, or $100, whichever is less.

c. Exceptions:

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

6. Indemnification

You agree to indemnify, defend, and hold harmless Patriot Realty Group, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms and Conditions or your use of the Site or Services, including, but not limited to, your User Content, any use of the Site or Services' content, services, and products other than as expressly authorized in these Terms and Conditions, or your use of any information obtained from the Site or Services.

7. Governing Law and Dispute Resolution

a. Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

b. Dispute Resolution:

Any legal suit, action, or proceeding arising out of or relating to these Terms and Conditions or the Site or Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas in each case located in the City of San Antonio. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

8. Termination

Patriot Realty Group may terminate your access to all or any part of the Site or Services at any time, with or without cause, with or without notice, effective immediately. All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Waiver and Severability

a. Waiver:

No waiver of by Patriot Realty Group of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Patriot Realty Group to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

b. Severability:

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.

10. Entire Agreement

These Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Patriot Realty Group with respect to the Site and Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Patriot Realty Group with respect to the Site and Services.
